I desire that the minor listed below (the Minor) be given the opportunity to participate in and utilize inflatable amusement devices at the Purim Carnival sponsored by and being held at Congregation Kol Ami. In consideration of such participation and use, I hereby agree to release and discharge Jewish Association of North Tampa, Inc, a Florida Corporation not-for-profit d/b/a Congregation Kol Ami and their respective agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their respective behalf (hereinafter collectively referred to as “Releasees”), and each of them, on behalf of myself, the Minor, the Minor’s parents, heirs, assigns, personal representative and estate as follows:

1. AWARENESS OF RISK, With respect to the inflatable or amusement devices, I am aware and understand that using such devices entails known and unanticipated risks to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: rented equipment failure; falling to the g round, falling onto other users, or being fallen on by other users; abrasions from the walls, floor or other participants; equipment failure; climbing or falling out of control or beyond one’s personal limits; the negligence of other participants, or of other persons who may be present inside or outside of the Inflatable Amusement Device, as the case may be; musculoskeletal injuries and/or head injuries; or the Minor’s own negligence. Furthermore, the Releasees have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant’s fitness or abilities. They may give inadequate warnings of instructions, and the equipment being used might malfunction.
2. ASSUMPTION OF RISK, On behalf of myself and the Minor I expressly agree and promise to accept and assume all of the risks existing in these activities, including the risk of any medical or physical condition the Minor may have. My allowing the Minor to participate in these activities is purely voluntary, and I elect to allow the Minor participate in spite of the risks.
3. RELEASE, On behalf of myself and the Minor I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless the Releasees, and each of them, from any and all claims, demands, or causes of action, which are in any way connected with the Minor’s use of the Inflatable Amusement Devices, including any such Claims which allege negligent acts or omissions of the Releasees, or any of them.
4. INDEMNIFICATION, By signing below, I certify that I am a parent or guardian of the minor listed below and that I have read this entire document and fully understand its contents and the type of risks inherent in Inflatable Amusement Devices participation and usage and agree to indemnify and hold harmless the Releasees, and each of them, from any and all Claims which are brought by, or on behalf of Minor, and which are in any way connected with such use or participation by Minor.
5. INSURANCE, I certify that I have adequate insurance to cover any injury or damage the Minor may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself.
6. MISCELLANEOUS, In the event that the Minor or I file a lawsuit against any one or more of the Releasees, I agree to do so solely in the state of Florida, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. Should any of the Releasees, or anyone acting on their respective behalf, be required to incur attorneys’ fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

By esigning this document, I acknowledge that if anyone is hurt or property is damaged during the Minor’s participation in either of these activities, the Minor and I may be found by a court of law to have waived our right to maintain a lawsuit against the Releasees, or one or more of them, on the basis of any claim from which I have released them herein.

 

I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
